1. Agreement to Terms
By accessing or using Brenva (the "Service"), operated at brenva.app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. "We," "us," and "our" refer to Brenva and its operators. "You" refers to the individual or entity using the Service.
2. Description of Service
Brenva is a revenue performance platform that analyzes websites, applications, and digital products to identify revenue optimization opportunities. The Service provides revenue analysis, prioritized recommendations, revenue projections, and ongoing monitoring through a web-based dashboard.
3. Account Registration
To access certain features, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized access or use of your account.
4. Subscription Plans and Payment
Brenva offers free and paid subscription plans. Paid plans are billed monthly or annually as specified at the time of purchase. By subscribing to a paid plan, you authorize us to charge your chosen payment method on a recurring basis until you cancel.
Prices are listed on our pricing page and are subject to change with 30 days' notice to existing subscribers. All prices are in U.S. dollars unless otherwise stated.
5. No Refunds
All payments are final and non-refundable. By subscribing to a paid plan, you acknowledge and agree that no refunds will be issued for any reason, including but not limited to partial use of the Service during a billing cycle, dissatisfaction with the Service, or failure to cancel before a renewal date. You may cancel your subscription at any time to prevent future charges, but no refund will be provided for the current billing period.
6. Cancellation
You may cancel your subscription at any time through your account dashboard. Upon cancellation, your access to paid features will continue until the end of the current billing period. After that, your account will revert to the free tier. We do not prorate or refund any unused portion of a billing period.
7. Acceptable Use
You agree not to:
- Use the Service for any illegal or unauthorized purpose
- Attempt to gain unauthorized access to our systems or other users' accounts
- Submit URLs or data that you do not own or have the right to analyze
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Resell, sublicense, or redistribute the Service or its outputs without written permission
- Use the Service to conduct any form of automated scraping, crawling, or data harvesting beyond normal use of the analysis functionality
- Interfere with or disrupt the integrity or performance of the Service
8. Intellectual Property
The Service, including all software, algorithms, designs, text, graphics, and other content, is owned by Brenva and is protected by intellectual property laws. You retain ownership of any data you provide to the Service. We retain ownership of all analysis outputs, scoring methodologies, rule engines, and analysis frameworks.
You are granted a limited, non-exclusive, non-transferable license to use the Service and its outputs for your internal business purposes only.
9. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy.
You acknowledge that the Service accesses publicly available information on your website and, when authorized by you, connects to third-party analytics and payment platforms via read-only integrations.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Revenue projections, scoring, and recommendations provided by the Service are estimates based on industry benchmarks and automated analysis. They are not guarantees of results. Actual outcomes may vary based on implementation, market conditions, and other factors outside our control.
We do not guarantee that the Service will be uninterrupted, error-free, or secure at all times.
11. Limitation of Liability
To the maximum extent permitted by law, Brenva and its operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the Service.
Our total liability for any claim arising from or related to these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Brenva and its operators from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third party's rights.
13. Termination
We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 5, 10, 11, 12, and 15 survive termination.
14. Changes to Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify you via email or through the Service.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Brenva operates, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.
